Terms of Use

These Terms of Use ("Terms") govern your access to and use of the YourScene public website, city signup and early-access flows, and mobile application (collectively, the "Services") operated by Section LLC ("Section," "we," "us," or "our").

By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Services. If you are under 18, you represent that you have parental or guardian permission where required.

Waitlist (website)

The website offers city-based signups and early-access updates for the mobile app. When you join, you may provide information such as your name, email, launch city (or another city), interests, whether you are a fan, venue, promoter, or similar role, and an optional note.

• One signup per email address. Duplicate submissions do not create additional entries.
• Accuracy. Provide information that is accurate to the best of your knowledge so we can prioritize launch cities and communicate with you.
• No guarantee of access. Waitlist placement does not guarantee early access, a specific launch date, or availability in your city.
• Communications. We may email you about launch timing, your selected city, and product updates. You can request removal from waitlist records as described on our Data Deletion page.

Waitlist data is processed as described in our Privacy Policy.

Accounts

The website signup does not create a full app account. App accounts are created inside the mobile application under separate flows.

For app accounts: you are responsible for safeguarding your login credentials and for activity under your account. Provide accurate information and notify us of unauthorized use at support@yourscene.app.

Acceptable use

You agree not to:

• Violate laws or others' rights
• Harass, threaten, impersonate, or spam users
• Upload malware or attempt to disrupt the Services
• Scrape, reverse engineer, or bypass security except as permitted by law
• Use the Services for unauthorized commercial solicitation
• Post illegal content or content you do not have rights to share
• Submit false or misleading waitlist information

We may suspend or terminate access that violates these Terms or our policies.

User content

You retain ownership of content you submit. You grant Section a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute your content solely to operate and improve the Services.

You represent that you have the rights to post your content and that it does not violate these Terms.

Events, venues, and third parties

Listings, RSVPs, crowd energy scores, and recommendations may be provided by users, venues, or partners. Section does not guarantee accuracy, safety, or availability of any event or venue. Attend events at your own risk.

Location and real-world safety

Location features are optional. Be aware of your surroundings. Do not use the Services while driving or in situations where distraction creates risk.

Intellectual property

The Services, including software, branding, and design, are owned by Section or its licensors. These Terms do not grant you rights to our trademarks except as needed to use the Services.

Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SECTION AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations; in those cases, limits apply to the fullest extent permitted.

Indemnity

You will indemnify and hold harmless Section from claims arising out of your content, your use of the Services, or your violation of these Terms.

Termination

You may stop using the Services at any time. You may delete your app account in-app (Profile → Settings → Account → Delete Account) or as described on our Data Deletion page.

We may suspend or terminate access with or without notice for violations, risk, or discontinuation of the Services.

Dispute resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, except where mandatory consumer protection laws apply in your country of residence.

Any dispute will be resolved in the state or federal courts located in Delaware, unless applicable law requires otherwise.

Changes

We may modify these Terms. Continued use after the effective date of changes constitutes acceptance. Material changes may be communicated on the website, in-app, or by email where appropriate.
